Warranty, Liability and Support
- Compliance with Australian Consumer Law
1.1 This warranty is provided in addition to, and does not exclude, restrict or modify, any rights or remedies available under the Competition and Consumer Act 2010, including the Australian Consumer Law (ACL).
1.2 The Purchaser is entitled to the benefit of statutory guarantees, including but not limited to:
- Goods being of acceptable quality
- Goods being fit for purpose
- Remedies for major and non-major failures
2. Hull Warranty (Structural – Manufacturer Provided)
2.1 The vessel hull is supplied with a three (3) year limited structural warranty, commencing from the date of delivery.
2.2 The hull warranty is:
- Issued and underwritten solely by the original manufacturer
- Limited to defects in materials and workmanship affecting:
- Structural integrity
- Weld integrity
2.3 Wild Boats acts solely as importer and supplier, and does not manufacture the hull.
2.4 Wild Boats will provide reasonable assistance in facilitating warranty claims with the manufacturer.
3. Warranty Claim Process (Hull)
3.1 All claims must:
- Be submitted in writing within a reasonable period of discovery
- Include sufficient detail and supporting evidence
3.2 The manufacturer (or its authorised representative) retains the right to:
- Inspect the vessel
- Determine the cause of any defect
- Decide whether the claim falls within warranty coverage
3.3 Where inspection is required:
- The Purchaser must make the vessel available at a location reasonably nominated by the manufacturer
- Where relocation is required, the Purchaser is responsible for reasonable transport and associated costs,
3.4 If a defect is confirmed by the manufacturer as a valid manufacturing defect:
- The manufacturer will, at its discretion, repair or replace the defective component or hull
3.5 If the issue is not a manufacturing defect:
- The Purchaser may be liable for reasonable costs incurred, including inspection, transport, and repair
4. Exclusions – Hull Warranty
4.1 To the extent permitted by law, the hull warranty does not apply to:
- Non-structural components
- Engines, propulsion systems, or mechanical components
- Electrical systems
- Trailers
- Electronics or accessories
- Third-party supplied or installed items
- Cosmetic defects arising after delivery
- Normal wear and tear
4.2 The warranty does not apply where damage arises from:
- Misuse, abuse, or negligence
- Impact, collision, grounding, or accident
- Failure to maintain the vessel in accordance with reasonable marine practice
- Corrosion due to inadequate maintenance
- Unauthorised modification, alteration, or repair
- Improper storage or environmental exposure
5. Paint Warranty
5.1 Paint systems are warranted for twelve (12) months from delivery against manufacturing defects only.
5.2 This warranty excludes:
- Fading, oxidation, or UV degradation
- Environmental exposure (including saltwater effects)
- Impact damage or abrasion
- General cosmetic wear
6. Outboard Motor Warranty
6.1 Outboard motors are supplied subject to the manufacturer’s warranty only.
6.2 Wild Boats:
- Provides no independent warranty in respect of engines
- Will provide reasonable assistance in directing claims to the relevant manufacturer or dealer
6.3 Where Honda Marine outboards are supplied, warranty terms are governed exclusively by Honda Marine.
7. Trailer Warranty
7.1 Trailers are supplied by Affordable Trailers Tasmania and are covered by a twelve (12) month manufacturer’s warranty.
7.2 Warranty coverage includes structural
components, subject to manufacturer terms.
7.3 The Purchaser must:
- Maintain the trailer in a safe and roadworthy condition
- Rinse and maintain the trailer after saltwater exposure
7.4 The warranty excludes:
- Normal wear items (including brakes, bearings, tyres, and lights)
- Lack of maintenance
- Modifications
- Misuse, overloading, or neglect
7.5 All claims must be made directly to the trailer manufacturer, with reasonable assistance from Wild Boats where required.
8. Third-Party Components
8.1 All third-party components supplied with the vessel, including but not limited to:
- Engines
- Trailers
- Electronics
- Accessories
Are covered solely by the warranties provided by their respective manufacturers.
8.2 Wild Boats will provide reasonable assistance to the Purchaser in facilitating such claims but accepts no independent liability for those components.
9. Limitation of Liability
9.1 To the maximum extent permitted by law:
- Wild Boats’ liability is limited to the remedies available under the ACL
- Wild Boats is not liable for indirect, consequential, or economic loss, including:
- Loss of use
- Loss of revenue or profit
- Downtime or operational interruption
10. General
10.1 The Purchaser acknowledges that:
- The hull is manufactured by a third party and all warranty claims fall under the manufacturer's warranty policy
- Warranty obligations are shared between multiple suppliers
- Proper maintenance and use are essential to maintaining warranty coverage
11. Unauthorised Repairs and Modifications
The warranty does not apply to, and may be refused in respect of, any defect, damage, or failure that:
- arises from or is contributed to by
- or is reasonably attributable to
any unauthorised repair, modification, alteration, or installation carried out without the prior written approval of the manufacturer or Wild Boats.
For the avoidance of doubt:
- The carrying out of repairs, modifications, or installations by the Purchaser or a third party does not automatically void the entire warranty
- However, any damage or defect caused by or related to such unauthorised work is excluded from warranty coverage
Where unauthorised work has been performed, the manufacturer reserves the right to:
- Decline the claim where it cannot be reasonably determined whether the defect is a manufacturing fault; or
- Require the Purchaser to rectify or remove the unauthorised work at their cost prior to further assessment
